Terms of Use

These Terms of Use govern the European Helpster website at https://helpstercharity.org/eu and its associated web donation checkout and donor-support services (the “Services”). The Services are provided by Helpster Charity, an Estonian non-profit association (mittetulundusühing, or MTÜ), registry code 80622371, with registered address at Juhkentali tn 8, Kesklinna linnaosa, Tallinn 10132, Estonia, operating as Helpster Charity Europe (“Helpster,” “we,” “us” and “our”). Helpster provides the Services to support essential medical treatment for children and other beneficiaries within our charitable purposes where adequate public assistance is unavailable (the “Goal”). These terms and conditions (the “Agreement”) explain how you may use the Services and how we accept donations. Please read this Agreement before donating. We will make it available for you to read and save before you confirm a donation. By accepting it at checkout, you agree to it. If you act for an organization, you confirm that you are authorized to do so. Any donation conditions we expressly agree with you separately take priority over conflicting provisions of this Agreement.

European Website and the App

All donations made through the European website’s donation checkout are made to the Estonian association Helpster Charity. We collect these donations through web payments processed by third-party payment providers on our behalf. The Helpster mobile application (the “App”) is a separate service. New one-time donations and new recurring subscriptions made through the App are received by Helpster Charity US, Inc. under its separate terms. These European website Terms do not govern those App donations. Following an App link from the European website does not make a subsequent App donation a donation to the Estonian association. Displaying or tracking an Estonian donation in the App does not change the charity that received it. Any existing recurring authorization to the Estonian association remains with that association under the authorization and donation terms applicable to it. This Agreement does not automatically replace those earlier terms, transfer an existing subscription or authorize payments to another charity.

Eligibility

You must be at least 18 years old and legally able to make a donation in order to use our donation features. If donating for an organization, you must have its authority. Beneficiaries receiving charitable assistance are not required to become donors or accept these Terms to receive assistance. Please provide accurate contact and payment information and notify us if information needed to administer your donation changes. You do not need to install the App or create an App account to make or cancel a web donation.

Donations, Payments & Refunds

How we use donations

Donations support our charitable Goal. Public donations for children’s treatment are allocated to hospital bills, after applicable third-party payment processing, bank transfer and currency conversion costs. We do not use these donations for our operating overhead, which is funded separately. Any separate contribution toward operating costs is optional and must be clearly identified before payment. Any additional amount charged to you by Helpster will be disclosed before you authorize it; your bank or payment provider may charge its own fees. Website donations normally support the most urgent open cases within our charitable program rather than a child selected by the donor. Helpster selects and verifies beneficiaries and remains responsible for the lawful use of donations, including when working with hospitals or partner organizations abroad. A donation is a gift to the Estonian association, not a direct payment to a child or a different Helpster organization. We use donations consistently with the appeal presented before payment. If a case is fully funded, treatment changes or cannot proceed, or funds remain, we may use unrestricted donations for other beneficiaries’ treatment within the same charitable purpose. Any restriction or condition we expressly accept must be honored and can be changed only with the donor’s consent or as otherwise permitted by law. We will not treat an expressly restricted gift as unrestricted merely because circumstances change. Treatment estimates and fundraising targets may change. A donation does not guarantee a particular treatment outcome, and does not give the donor ownership rights, a financial return, or authority over a child’s care.

Payments

We accept the payment methods displayed at checkout. Before you confirm payment, you can review the donation recipient, amount, currency, any additional amount charged by us and, if applicable, the recurring schedule, and correct your information. You confirm that you are authorized to use the selected payment method and authorize only the payment details you expressly accept. Donations under these Terms are voluntary gifts, not purchases of goods, services or digital content. We will send a confirmation identifying the recipient and donation details after a successful payment. A payment request or recurring authorization is not an enforceable promise to make future gifts; you may stop future payments as described below. We may decline or return a donation where required by law or where we reasonably suspect fraud, an unauthorized payment or unlawful activity. We may request information reasonably needed to verify a donation or meet legal obligations. We use third-party payment providers and reasonable security measures, but no internet transmission is completely secure. For donation or payment problems, please contact team@helpstercharity.org; you may also contact your bank or payment provider. Nothing in this Agreement removes their obligations or your legal rights concerning unauthorized payments or payment errors.

Refunds and statutory rights

Completed donations are generally not refundable, except where required by law or where we approve a refund. Please contact team@helpstercharity.org promptly if you believe there has been a duplicate charge, processing error, unauthorized payment or another mistake. We will review your request and make any refund required by law; we may also approve an appropriate refund in other exceptional circumstances. Approved refunds are normally returned to the original payment method. Nothing in this Agreement excludes your statutory rights to withdraw from a gift agreement or recover a gift under Estonian law, including the rights and conditions in sections 267–270 of the Law of Obligations Act. Nor does it exclude any other mandatory withdrawal, refund or payment-dispute right applicable to your transaction. A request is not rejected merely because you did not notify us within a shorter period than the law allows. Cancelling a recurring donation does not automatically refund earlier, properly authorized donations, but does not limit any applicable refund or payment-dispute rights.

Recurring Donations

Before you subscribe, we will show the recipient, donation amount, currency, frequency and when charges begin. Recurring payments require your separate affirmative authorization; accepting these Terms alone is not authorization. We will provide a confirmation of that authorization, including the payment schedule and cancellation instructions, in a form you can retain. Payments continue on the agreed schedule until cancelled. You may cancel at any time by emailing team@helpstercharity.org or by using any donation-management link provided with your subscription. You do not need to install or use the App to cancel. There is no cancellation fee or obligation to make further donations. We will process cancellation promptly, confirm it, and not initiate further charges under the cancelled authorization after receiving your request. A payment already submitted for processing may still settle; contact us if that happens. Cancelling a newsletter, deleting the App or closing an App account does not itself cancel a payment authorization. We will not increase the amount or frequency, or change the donation recipient, without your fresh authorization. Changes to these Terms do not themselves amend a recurring-payment authorization. Each completed payment is a separate donation.

Tax Treatment & Donation Receipts

We will provide a donation confirmation identifying Helpster Charity, registry code 80622371, as the recipient, together with the date, amount and currency. Please retain this confirmation and contact us if you need supporting information for your tax records. Any tax relief depends on your circumstances and the rules of the relevant country. Please check with your tax consultant for the information for the possible tax relief on the donation. Where required by Estonian law, we report donation information to the Estonian Tax and Customs Board. We may ask for the identification information needed for that reporting, as explained in our Privacy Policy. Please check your own tax return and obtain tax advice if needed. A donation to the Estonian association is not a donation to Helpster Charity US, Inc. Its US tax-exempt status does not apply to our receipts or convert an Estonian donation into a US charitable contribution.

Privacy & Communications

Our Privacy Policy at https://helpstercharity.org/privacy-policy explains how personal data is collected, used and shared, including the roles of the organizations involved. Helpster Charity is responsible for processing personal data for its administration of European website donations and its legal obligations. Accepting these Terms or making a donation is not consent to optional marketing or non-essential cookies. Where consent is required for analytics or advertising technologies, including Google Analytics or Meta technologies, we will request it separately and allow you to withdraw it. Your donation does not depend on agreeing to optional marketing or cookies. We may send donation confirmations, cancellation confirmations, security alerts and other necessary service communications electronically. You may opt out of marketing without cancelling your donations. Please do not send payment card details by email or disclose a child’s identifying or medical information without appropriate authority. You may report unlawful content or concerns about a beneficiary’s privacy or safety to team@helpstercharity.org, identifying the content and explaining your concern.

Intellectual Property

The Services and all content and information therein, such as text, graphics, designs, logos, catalogs, images, presentations, button icons, videos, data, instructions, photographs, graphs, typefaces, sounds, and software (the “Materials”), are the property of Helpster or its licensors. Your use of any of the trademarks found on the Services, or any confusingly similar marks, without express permission of the owner is strictly prohibited.

Limited License

You may access the Services and view the Materials for personal, non-commercial purposes connected with the Goal. You may share links to our public pages and use sharing features we provide. Other reproduction or use requires the relevant rights holder’s permission unless permitted by law. Keep all copyright and other proprietary notices. No permission is granted to republish beneficiaries’ photographs or medical information merely because they are accessible on the website.

Restrictions on Use

You agree not to: • Use Materials (including images of children) in violation of applicable laws or without appropriate consent; • Create a database by systematic downloading or storage of Materials; • Copy, modify, remove, publish, distribute, sell, license, or create derivative works from the Materials or Services, except as expressly permitted; • Interfere with, disable, or attempt to manipulate the Services, including security features or access controls; • Upload or transmit viruses, worms, malware or other malicious code; • Use automated means (robots, spiders, scrapers, scripts) to access the Services without prior written consent, except as permitted by mandatory law; • Attempt to access accounts or data without authorization; • Provide false or misleading information or use a payment method without authority; • Impose an unreasonable load on Helpster’s infrastructure; • Collect, solicit, or misuse personal data of users in violation of applicable privacy laws or our Privacy Policy; • Use the Services for unauthorized commercial purposes; or • Use the Services in a misleading, malicious or discriminatory manner, or otherwise in violation of applicable law, including data-protection and sanctions laws.

Helpster’s Rights

We may update the Services, remove content that violates this Agreement, and restrict access where reasonably necessary to protect users, beneficiaries or the Services, or to comply with law. We will give notice where reasonably practicable, but may act immediately in cases involving fraud, security, child safety or other urgent concerns. These rights do not override our obligations concerning donations, accepted restrictions, cancellations, refunds or personal data.

Availability & Medical Information

We aim to keep the Services accurate and available, but cannot guarantee uninterrupted or error-free access. Nothing in these Terms excuses misleading fundraising statements or excludes a duty that cannot lawfully be excluded. Information about beneficiaries and treatment is provided for transparency and fundraising, not as medical advice. Please consult qualified professionals for medical concerns. Medical images or descriptions may be distressing; viewer discretion is advised.

Liability

To the extent permitted by law, Helpster is not liable for indirect or consequential losses arising from use of the Services, and our total liability under this Agreement is limited to Euro 100. These limitations do not apply to fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or liability that cannot lawfully be excluded or limited. They do not reduce our obligations to apply donations lawfully and consistently with accepted restrictions, make required refunds, or respect your mandatory payment and data-protection rights.

Complaints, Governing Law & Disputes

Please send questions or complaints to team@helpstercharity.org, with enough information for us to identify the issue and, where relevant, the donation. We will acknowledge receipt and provide a reasoned response within 15 days. If we need more time, we will explain why and give a reasonable new response date, subject to any mandatory legal deadline. This Agreement is governed by Estonian law. This choice does not deprive you of any mandatory protection that applies under the law of your country of habitual residence. Courts with jurisdiction under applicable law may hear a dispute; these Terms do not require you to bring a claim only in Estonia where mandatory rules allow you to bring it elsewhere. The time limits set by applicable law apply to claims. This Agreement does not impose a shorter contractual deadline.

Term and Termination

You may stop using the Services at any time and cancel recurring donations as described above. We may restrict or end access for a material breach or the protective reasons described in “Helpster’s Rights,” with reasonable notice where practicable. We will not prevent you from cancelling donations or exercising your legal rights. Ending access does not change the recipient of a donation or release us from obligations concerning donations already received. Provisions intended to continue, including intellectual property, lawful use of donations, liability and dispute provisions, continue to apply.

Waiver & Modifications

If a provision is invalid or unenforceable, applicable law replaces it where required and the remaining provisions continue to apply to the extent permitted by law. A failure to exercise a right does not mean that the right is waived. We may update these Terms to reflect changes in law, payment processes or the Services. We will post the revised version with an updated date and give reasonable advance notice of material changes affecting existing donors, normally by email where we have their address. Changes apply prospectively and do not alter completed donations, accepted restrictions or existing payment authorizations. We will obtain fresh acceptance or consent where required; silence is not authorization for a different payment.
